EACH WINNER MUST BE PREPARED TO TRAVEL INTERNATIONALLY THE WEEK OF JUNE 11,
2012.
1. The Samsung “Olympic® Flame Torchbearers” Contest (the
“Contest”) begins at 12:01 a.m.
Eastern Time (“ET”) on Monday, September 19, 2011 and ends at 11:59 p.m. ET on Monday,
October 3, 2011 (“Contest Entry Period”).
2. Eligibility: The Contest is open only to legal residents of the
fifty (50) United States and the District of Columbia who are 18 years of age
or older at the time of entry (the "Nominator").
Nominators may nominate a special teacher who shows a commitment to students
both in and out of the classroom (the "Nominee"). Nominees are currently employed as teachers in a public or private
Elementary School, Middle School, Junior High School, High School, (K-12
grades). Employees of Samsung
Electronics America, Inc. (“Sponsor”),
Cohen-Friedberg Associates, LLC ("Administrator"),
LOCOG® (London Organizing Committee of the Olympic Games), USOC® (United States
Olympic Committee), IOC® (International Olympic Committee), and their
respective parents, affiliates, subsidiaries, advertising and promotion
agencies, retailers, distributors and suppliers (collectively the "Contest Entities"), and the immediate families (spouse, parents, children and siblings
and their respective spouses, regardless of where they reside) and individuals
living in the same households of any of the foregoing individuals, whether or
not related, are ineligible to participate or win a prize. Subject
to all applicable federal, state and local laws and regulations.
3. Nomination process: You may enter the Contest by visiting www.samsung.com/us/torchrelay
and accessing The Samsung® Olympic® Flame Torchbearers
Contest registration page and following the directions to complete and submit
the Official Entry Form (collectively, the “Entry”). As part of the Entry process you must enter a teacher
nomination essay (not to exceed 250 words in length) that includes; why your
teacher deserves the honor of carrying the Olympic® Torch in London in 2012.

Nominators Obligations When
Registering:
1. Nominator has told the
nominee and received consent
that they are being nominated in this Contest.
2. Enter the Nominees personal
data as required.
3. To insure that entered
information is accurate. Inaccurate or omitted information will result in the
nomination being removed from the nomination process and/or offer of a
Torchbearer slot being withdrawn.
4. Enter the nomination prior
to 11:59 p.m. ET on Monday, October 3, 2011 to be considered.
Decisions of Judges are final
and legally binding. Entries generated by script, macro or other automated
means and entries by any other means which subvert the entry process or are
otherwise not in compliance with these Official Rules are void. Limit: Only one
(1) Nomination will be considered for each Nominee. Nominators may nominate
more than one Nominee. Teachers may nominate themselves or other outstanding
teacher(s). All entries become the property of the Sponsor and will not be acknowledged
or returned. Except as otherwise provided herein, Sponsor
will not enter into any correspondence with an entrant regarding an entry.
Entry must be entrant’s own original work, be true and verifiable, cannot be
previously published or submitted in connection with any other Contest, may not
be offensive or inappropriate and may not contain profanities or obscenities
nor depict Sponsor, or LOCOG® unfavorably, as determined by Sponsor or the
Administrator in their sole discretion. Entries must be consistent with the
images of the Sponsor and must not defame or invade publicity rights or privacy
of any person, living or deceased, or otherwise infringe upon any person’s
personal or property rights or any other third party rights. Sponsor reserves
the right in its sole discretion to disqualify any entry it determines does not
comply with these requirements or these Official Rules, in its sole discretion.
AS A CONDITION OF
PARTICIPATING, NOMINATORS AGREE TO THE FOLLOWING A) AND ACCEPTANCE THESE OFFICIAL RULES AND THE DECISIONS OF THE
SPONSOR AND THE ADMINISTRATOR, WHICH ARE FINAL AND BINDING IN ALL MATTERS
RELATED TO THE CONTEST; B) RULES INFORM NOMINEE OF THESE A) UNDER NO CIRCUMSTANCES WILL NOMINATORS OR NOMINEES BE PERMITTED TO OBTAIN AWARDS FOR, AND YOU
HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY
OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT OF POCKET EXPENSES, IF ANY, AND B) ALL CAUSES OF ACTION ARISING OUT OF
OR CONNECTED WITH THIS CONTEST, OR ANY COMPENSATION OR CREDIT TO BE PROVIDED,
SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND
C) ANY AND ALL CLAIMS, JUDGMENTS,
AND AWARD SHALL BE LIMITED TO ACTUAL OUT OF POCKET COSTS INCURRED, IF ANY, AND
IN NO EVENT SHALL NOMINATORS OR NOMINEES BE ENTITLED TO RECEIVE ATTORNEYS’ FEES
OR OTHER LEGAL COSTS OR EXPENSES.
SOME JURISDICTIONS DO NOT ALLOW THE
LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES,
SO THE ABOVE MAY NOT APPLY TO YOU.
4. Judging and Judging
Criteria: All eligible entries
received during the Contest Entry Period, will be judged on the following
criteria by a panel of qualified judges comprised of Samsung Executives and an
independent Judge selected by Samsung, Mr. John Legend (collectively the "Judges").
30% Quality of content and adherence
to theme
30% Inclusion of specific
points and/or examples illustrating the answer
30% The submission
demonstrates Nominees "going the extra mile"
10% Writing style and grammar
Subject to verification of
eligibility and compliance with these Official Rules, the five (5) entries with
the highest judging scores will be deemed potential winners (subject to
verification of eligibility). In the event of a tie, an additional
“tie-breaking” Judge will determine the entrants who will win based on the
above stated criteria.
5. Winner Notification/Notices: Each
Nominator and Prize Winner ("Prize Winner"
is defined as nominees who have been selected as winners by the judging panel
and have met the judging criteria), will
be notified via telephone, mail and/or email on or around October 4, 2011. If
any notification including e-mail to a potential Prize Winner is undeliverable,
any phone number that is incorrect or no longer in service, a response to any
given e-mail or phone call is not received within two (2) business days of date
of its issuance or any potential Prize Winner that does not comply with these
Official Rules, the opportunity to participate in the Contest may be forfeited
and, at Sponsor’s discretion, an alternate Entry (entry with the next highest Judges score) may
be selected. Each Nominator and Potential Prize Winner will be required to
complete and sign and Affidavit of Compliance and
Release and Publicity Form. in addition each Winner
must sign and return a Torchbearer Relay form as requested by the LOCOG (if
any) including a criminal background check.
Nominees and Nominators must
agree to the following:
a. to take part in media
interviews including but not limited to magazine, television and radio
interviews;
b. to be photographed by the Sponsor for the purposes of promoting the Contest
and the Sponsor's products;
c. to participate in the Sponsor's other marketing and promotional activities
as related to the Torchbearer slot;
d. assigns to the Sponsor free of charge, and waives all moral rights in, all
intellectual property (including without limitation the copyright) owned by the
Nominator in the Nomination, the Content, and any other information, data, or
document(s) provided by the Nominator to the Sponsor in the course of the
Nomination Process, or that is otherwise provided to the Sponsor. The Nominator
agrees to take any further action (including, without limitation, the execution
of documents) reasonably requested by the Sponsor to give effect to, perfect or
confirm the Sponsor's ownership of such intellectual property; and
e. to be filmed, televised, photographed and/or otherwise recorded in
connection with the Torchbearer Slot, and agrees that the Sponsor, its
affiliates, and LOCOG® shall be permitted to use such films, photographs and
recordings and the Nominator's image and likeness for any purpose, including to
promote the Sponsor's brand, products and services.
6. Prize Details:
Five (5) Grand Prizes: 4/day-3/nights Trip for (1) to
London to participate in the Olympic® Torchbearer
Relay event (Week of June 11, 2012). Prize consists of the following elements:

Roundtrip (coach
class) air transportation to Edinburg, London from a major U.S. gateway airport
nearest the winner's home address (as determined by Sponsor).
·
(3)
nights hotel
accommodations.
·
Ground
transportation to/from airport and hotel and the Torchbearer relay event.
·
Participation in
the Torchbearer Relay event. Each Prize Winner will have the opportunity to
carry the Olympic Torch for between 200 and 300 meters at a location in the UK (the
"Torchbearer Slot") during
th week of June 11, 2012 (exact date and location
to be determined by the Sponsor and/or the LOCOG® and at their sole discretion).
The Torchbearer Slot carries no cash value and
is non-transferable.
Total
approximate retail value of each prize package $10,000. Actual Grand Prize
package value may vary based upon departure city.
Travel
Arrangements: Travel restrictions may apply. Prize Winner must travel on the itinerary
as established by the Sponsor and in its sole discretion. Any guest of the Prize Winner, must be of
legal age of majority in his/her state of residence (and at least 18), unless
he/she is accompanied by a parent or legal guardian (Please note, any additional guest(s) beyond the Prize
Winner shall be at the sole expense of the winner and or guest). If Prize
Winner is unable to travel on dates specified by Sponsor, the applicable prize
package will be forfeited and Sponsor will have no further obligation to the Prize
Winner. Prize Winner is responsible for obtaining all required international travel
documents including a valid Passport, prior to travel by airline and to check
into a hotel. Prize Winner is responsible for all costs and expenses associated
with the acceptance and use of the trip not specified herein as being awarded,
including, but not limited to, all federal, state and local taxes, luggage
fees, additional ground transportation, meals, gratuities and souvenirs. Exact
date and location of Winner Announcement will be determined by Sponsor.
ALL
PRIZES ARE PROVIDED “AS IS” WITH NO WARRANTY OR GUARANTEE OF ANY KIND, EITHER
EXPRESS OR IMPLIED. Prizes are not transferable, redeemable for cash, or
substitutable except Sponsor retains the right at its discretion to substitute
a prize, or portion of prize, with one of comparable or greater value. Prize
Winner will be responsible for all taxes, if any (including federal, state and
local taxes) and other costs and expenses associated with the acceptance and
use of a prize (or any portion thereof) not included with prizes as awarded.
7. General Rules: The Contest is governed by the laws of the United
States, state of New Jersey without regard its conflict of laws principles with
venue in Bergen County, and all claims must be resolved in the courts of Bergen
County, New Jersey. By participating, entrants agree as follows: a) to abide by
these Official Rules, and to the decisions of Sponsor, Administrator, and the Judges,
which shall be final and legally binding in all respects; b) to the use of
their names and/or likenesses and/or biographical data by Sponsor and its
designees for advertising, promotional and other purposes in any and all media
now or hereafter known throughout the world for a period of two (2) years from
the conclusion of the Contest at discretion of Sponsor without compensation,
permission or notification (except where prohibited by law); and c) that the Contest
Entities, and their respective parents, affiliates, subsidiaries, advertising
and promotion agencies, retailers, distributors and suppliers, and each of
their respective officers, directors, shareholders, agents, and employees
(collectively, the “Released Parties”)
shall have no liability and entrant shall indemnify and hold harmless the
Released Parties from and against any damage, loss or injury resulting, in
whole or in part, directly or indirectly, from participation in this Contest
(including any travel/activity related thereto), violation of these Official
Rules, the use or misuse of any prize or Released Parties’ use of any rights
granted herein. By accepting a prize, each Prize Winner agrees to release and entrant
shall hold harmless Released Parties from and against any damage, loss or
injury resulting from the use or misuse of any prize or Released Parties’ use
of any rights granted herein. Released Parties are not responsible for lost,
interrupted or unavailable network, server or other connections,
miscommunications, failed phone, computer or telephone transmissions or
technical failure, jumbled, scrambled or misdirected transmissions, scoring
errors or other problems or errors related to participation in the Contest or
other errors or problems of any kind whether typographical, printing, human,
mechanical, computer, electronic or otherwise relating to or in connection with
the Contest, including, without limitation, errors or problems which may occur
in connection with the administration of the Contest, the processing or judging
of entries, the announcement of the prizes or in any Contest-related materials
or for any damage to your or other person’s computer hardware or software as a
result of participation. Released Parties are not responsible for entries that
are late, lost, stolen, incomplete, inaccurate, undelivered, misdirected,
garbled or delayed by computer transmissions. Persons found tampering with or
abusing any aspect of this Contest or who are in violation of these Official
Rules as solely determined by the Administrator will be disqualified and all
associated entries will be void. Every submission must be manually entered by
the individual participant and repetitive automated electronic submission of
entries is specifically disallowed. In the event the Contest is compromised by
virus, bugs, non-authorized human intervention or other causes which corrupt or
impair the administration, security, fairness or proper play of the Contest, or
if Contest is unable to run as planned for any other reason, Sponsor reserves
the right in its sole discretion to suspend or terminate the Contest or any
portion thereof and/or terminate the participation of any participant (and void
his/her entry) whose conduct potentially compromises the Contest and, if
terminated, at Sponsor’s discretion, judge all eligible, non-suspect entries
received up to time of such action using the applicable judging procedures
outlined above.
8. Winners List: For names of the Prize Winners
(available after 12/31/2011), send a self addressed stamped envelope to "The

Centre, MA 02459. all requests must be received by 12/31/11
